Charity registration

Many PTAs meet the requirements to register as a charity, so Parentkind actively promotes charity registration for all eligible associations. There is no charge currently for PTAs to register as a charity. Charity registration provides formal recognition of the PTA and gives your association a legal status which is publicly acknowledged.

In England and Wales it is a legal requirement for organisations engaged in charitable activities, with an annual income of more than £5,000, to register as a charity with the Charity Commission. For more information see Charity Registration - England and Wales. 

In Northern Ireland it is now a legal requirement for all PTAs to register as a charity, regardless of size or income level, or whether they have already received charitable tax status from HMRC. There are no exceptions or exemptions, and failure to register could result in High Court Action against your PTA committee members. The Charity Commission for Northern Ireland (CCNI) has appointed Parentkind NI as a 'Helper Group' and recommends that "All PTAs contact Parentkind NI for guidance on registering under its approved common governing document." Mae nifer o PTAs yn cyflawni’r amodau i gofrestru fel elusen, felly mae Parentkind yn hyrwyddo cofrestru fel elusen yn weithredol ar gyfer pob cymdeithas gymwys. Ar hyn o bryd nid oes tâl ar gyfer PTAs i gofrestru. Mae cofrestru fel elusen yn darparu cydnabyddiaeth ffurfiol o'r PTA ac yn rhoi statws cyfreithiol i'ch cymdeithas sy'n cael ei gydnabod yn gyhoeddus.

Yng Ngogledd Iwerddon, mae nawr yn ofynnol i bob PTA gofrestru fel elusen, waeth beth yw eu maint neu lefel incwm, neu os ydynt eisoes wedi derbyn statws treth elusennol gan Gyllid a Thollau EM. Nid oes unrhyw eithriadau, a gallai methu â chofrestru arwain at achos Uchel Lys yn erbyn aelodau'ch pwyllgor PTA.

Mae Comisiwn Elusennau Gogledd Iwerddon wedi penodi Parentkind NI fel ‘Grŵp Cynorthwyol' ac yn argymell y dylai "Pob PTA gysylltu â Parentkind NI ar gyfer canllawiau ar gofrestru o dan ei ddogfen lywodraethol gyffredin a gymeradwywyd."
